Ball Horticultural Company maintains portions of BallIngenuity.com (the Site) designed to facilitate information exchange between you and Ball related to your plant breeding ideas, including submission of information, pictures, and other content (each a “Plant Concept”). Ball does not own any Plant Concept, but we do need certain licenses from you for each Plant Concept in order to maintain the Site. When you submit a Plant Concept, you agree to these terms:

  • We can use the content you’ve submitted for evaluation purposes. You grant to us, and others acting on our behalf, the worldwide, non-exclusive, royalty-free right to use your Plant Concepts for internal purposes to evaluate the marketability and commercial opportunities associated therewith. This is not an offer for sale.
  • Confidentiality. Ball agrees to maintain Plant Concepts confidentiality and shall not disclose any Plant Concept to any third person not employed by Ball unless required by law after as much advance notice to you as practical.
  • No guarantee. You may submit Plant Concepts to us through the Site. You agree that Ball may contact you regarding the commercialization of one or more Plant Concepts. However, you acknowledge that Ball does not guarantee any commercial opportunities with respect to any Plant Concept you submit. You further agree that submission of a Plant Concept does not constitute an offer for sale, or a solicitation of an offer to buy, any interest in any Plant Concepts.
  • Intellectual Property. You shall be solely responsible for your Plant Concepts and the consequences of submitting Plant Concepts through the Site. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to submit the Plant Concepts you submit.
